Alternatives to divorce

Separation agreements

It is usually helpful to set out what has been discussed and agreed in writing.

This can be done easily. The document is usually called a separation agreement or deed of separation.
It is worth getting a solicitor to prepare this document so that it covers all of the points that need to be made. There is no set format for these documents but they may include:
  • whether or not a divorce is planned in the future;
  • what the arrangements are for the children;
  • what maintenance is going to be paid; and
  • what is going to happen to the house.

 

Disadvantages

Separation agreements are not legally binding and can be set aside by the court in subsequent divorce proceedings.
